By approving content and final website design, the client assumes full responsibility for its legality, appropriateness, and compliance with applicable laws and regulations.


Limitation of Liability
Edgar Solis Marketing will not be held liable for any direct, indirect, incidental, or consequential damages, including but not limited to loss of profits, revenue, or reputation, arising from:

The use or operation of any website, materials, or services provided.
Errors, delays, or interruptions in website functionality.
Any decisions or actions are taken based on information provided by Edgar Solis Marketing.


Add-Ons and Additional Services
Any requested features, revisions, or add-ons beyond the scope of the original agreement will incur additional charges and must be paid upfront. Edgar Solis Marketing is not responsible for delays caused by late approvals or additional requests from the client.

Project Timelines and Payment Terms
Clients are required to adhere to agreed payment terms. Full payment must be made within 60 days of the project start date, regardless of additional work requested. Failure to make timely payments may result in suspension of services or legal action to recover unpaid balances.

 

Third-Party Tools and Platforms
Edgar Solis Marketing uses third-party platforms, including Wix, to deliver website services. While we work to ensure smooth integration and functionality, we are not responsible for any issues, limitations, or changes in these third-party tools that may affect the website.

Governing Law
The laws of Colorado govern this disclaimer and all services Edgar Solis Marketing provides. Any disputes arising from using our services will be resolved per these laws.

Acknowledgment
By engaging Edgar Solis Marketing, clients acknowledge and agree to this disclaimer, taking full responsibility for their decisions and actions related to the use of our services.

Website Design & Branding Terms & Conditions

1. General Agreement
By engaging Edgar Solis Marketing's services, the client agrees to the following terms and conditions. These terms ensure transparency, protect both parties and establish clear expectations for the project.

2. Payment Terms

  • A 50% deposit is required to begin any project, with the remaining balance due within 60 days of the project start date, regardless of the project’s completion status.

  • Any additional work or changes outside the original scope of the project must be requested in writing and will be billed separately. Payment for additional work must be made upfront before work begins.

  • Failure to make payments on time may result in project delays, suspension of services, or additional late fees.

3. Content Responsibility

  • Edgar Solis Marketing is not an expert in the client’s field and will provide content based on the information and guidance provided by the client.

  • The client is responsible for reviewing and approving all content. By approving the content, the client accepts full responsibility for its accuracy, legality, and appropriateness.

  • Edgar Solis Marketing is not liable for errors, inaccuracies, or omissions in content once it has been approved by the client.

4. Final Approval and Website Responsibility

  • Upon the client’s final approval of the website, the client accepts full responsibility for the site’s content, design, and functionality.

  • Edgar Solis Marketing will not be held liable for any harm, financial loss, or damages resulting from the use of the website, its content, or functionality. The client acknowledges that they are solely responsible for how the website is used and perceived.

5. Liability Disclaimer

  • Edgar Solis Marketing provides services "as is" and does not guarantee specific business outcomes or results.

  • The client agrees that Edgar Solis Marketing is not liable for any harm, loss, or damages, including but not limited to lost profits, revenue, or reputation, arising from the use or operation of the website or services provided.

6. Revisions and Add-Ons

  • Each project includes a set number of revisions as outlined in the package. Additional revisions or features requested will be billed at the hourly rate of $100/hour and must be approved and paid upfront.

  • Clients are encouraged to finalize all revision requests within the agreed project timeline to avoid delays.

7. Termination Policy

  • Either party may terminate the agreement at any time with written notice. In such cases, the client will be invoiced for all work completed up to the termination date, including any unpaid balances.

8. Miscellaneous

  • Edgar Solis Marketing reserves the right to showcase completed projects in its portfolio unless otherwise agreed in writing.

  • Any disputes arising from these terms will be resolved under the jurisdiction of the governing laws of Colorado.

Terms and Policies for Maintenance Plans

By subscribing to any of our website maintenance plans, you agree to the following terms and policies. These terms ensure clarity, set proper expectations, and protect both parties.
Scope of Work
 

  1. Plan-Specific Services:

    • Each plan includes the services outlined in its description.

    • Updates are limited to the number and type specified in your plan. Additional updates will be billed at the discounted rate of $100/hour.

    • Services are restricted to websites built and maintained on the Wix platform.

  2. Time Limits:

    • Each plan has a monthly time limit for development, design, and content work.

    • Unused hours do not roll over to the next month.

  3. Additional Work:

    • Work beyond the scope of your plan (e.g., new pages, major redesigns) will require an additional quote or hourly billing.

    • E-commerce updates or product uploads are billed at $75/hour unless otherwise agreed.

  4. Exclusions:

    • Plans do not cover third-party hosting issues, domain renewals, or app subscriptions unless explicitly noted.

    • Clients requiring training or extensive troubleshooting should inquire about additional services.
       

Customer Support

  1. Support Access:

    • Email support is included with all plans, with response times varying by tier:

      • Bronze Plan: 72-hour response time

      • Silver Plan: 48-hour response time

      • Gold Plan: 24-hour response time

      • Platinum Plan: 12-hour priority response time

  2. Consultation:

    • Monthly consultations are offered as specified in your plan.

    • Unused consultation time does not roll over to the next month.

  3. Urgent Requests:

    • Urgent issues may incur additional fees if outside standard support hours or plan scope.
       

Turnaround Times

  1. Update requests will be completed within the timeframes specified by your plan:

    • Bronze Plan: 14 business days

    • Silver Plan: 10–14 business days

    • Gold Plan: 5–7 business days

    • Platinum Plan: 3–4 business days

  2. Rush requests are subject to availability and may incur additional fees.


Cancellation Policy

  1. Cancellation Terms:

    • Plans can be canceled at any time by providing written notice.

    • The final month of service must be paid in full.

  2. No Refunds:

    • Payments for services already rendered or the current month’s service are non-refundable.


Client Responsibilities

  1. Content Review:

    • Clients are responsible for reviewing and approving all content provided or updated on their website.

    • Edgar Solis Marketing is not liable for errors, omissions, or inaccuracies in client-provided content.

  2. Access Credentials:

    • Clients must maintain their login credentials for hosting, domain, and website accounts.

  3. Communication:

    • Clear communication is required for all update requests. Delays due to incomplete or unclear instructions may extend completion times.


General Terms

  1. Service Limitations:

    • Plans are intended for maintenance and updates, not ongoing development. Frequent or complex updates may require upgrading to a higher plan.

  2. Payment Terms:

    • Payment is due monthly. Late payments may result in suspension of services.

  3. Liability:

    • Edgar Solis Marketing is not responsible for loss of income, data, or damages due to website downtime, errors, or client-requested changes.

  4. Policy Updates:

    • Terms and policies may be updated periodically. Clients will be notified of significant changes.
